Introduction

Welcome to Funnelhyve. These Terms and Conditions ("Terms") govern your use of our services, platforms, and products ("Services"). By accessing or using Funnelhyve's Services, you agree to comply with and be bound by these Terms. Please read them carefully.

Your use of our Service is governed by our Privacy Policy, which also describes how we gather, protect, and share data that comes from your visits to our websites.

These Terms and our Privacy Policy (collectively, the "Agreements") constitute your agreement with us. You agree to be bound by the Agreements and confirm that you have read and understand them.

You may not use the Service if you disagree with (or are unable to comply with) the Agreements, but please email [email protected] to let us know so we can try to find a solution. All visitors, users, and other individuals who want to access or use the service must abide by these terms.

Definitions

"User" or "You" refers to any person or entity accessing or using the Services. "Company" refers to FUNNELHYVE, the provider of the Services. "Services" refers to all of the features, applications, material, and functionalities that the company offers.

Eligibility

Users must be at least 18 years old or have reached the age of majority in their jurisdiction to use our Services. By using the Services, you represent and warrant that you meet this age requirement. If you are not at least eighteen (18) years old, you are prohibited from both the access and usage of Service.

Acceptance of Terms

FUNNELHYVE is a white-labeled SaaS application built on the Go High Level (GHL) platform. These Terms govern your use of FUNNELHYVE and any related services provided by us.

Communications

By using our Service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or by emailing at [email protected].

Account Registration and Use

To use some of  FUNNELHYVE's features, you have to create an account. During the registration procedure, you undertake to give accurate, comprehensive, and up-to-date information, and to maintain such information updated. You bear the responsibility of keeping your password and account private.Your credit or debit card number, the card's expiration date, your billing address, and your shipping information are just a few of the details you might be asked to provide if you want to buy any good or service made available through the service (the "Purchase").

You affirm and guarantee that: (i) the information you provide to us is true, accurate, and complete; and (ii) you have the legal authority to use any card or other payment method in connection with any Purchase.

In order to expedite payment and the fulfillment of Purchases, we could make use of third-party services. You give us permission to share your information with these third parties by submitting it.

We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.

We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

Subscription Fees and Payments

Funnelhyve charges subscription fees for access to the platform. These fees are billed in advance on a recurring basis ("Billing Cycle"). Billing cycles will be set depending on the type of subscription plan you select when purchasing a Subscription.

All fees are non-refundable, including if you decide to terminate your subscription early or if your account is suspended or closed due to a violation of these Terms.

Certain portions of the Service are billed on a subscription basis ("Subscription(s)"). Depending on the type of subscription plan you choose when purchasing a Subscription, you will receive advance billing on a recurring and periodic basis ("Billing Cycle").

Unless you cancel or Funnelhyve cancels, your Subscription will automatically renew at the end of each billing cycle under the same terms. You can cancel your Subscription renewal by contacting the customer support staff at [email protected].

You shall provide Funnelhyve with accurate and complete billing information that may include but not limited to full name, address, state, postal or zip code, telephone number, and a valid payment method information. By submitting such payment information, you automatically authorize Funnelhyve to charge all Subscription fees incurred through your account to any such payment instruments.

Should automatic billing fail to occur for any reason, Funnelhyve reserves the right to terminate your access to the Service with immediate effect.

Fee Changes

Funnelhyve reserves the right to change the Subscription costs at any time and in its absolute discretion. Any changes to the subscription charge will take effect at the conclusion of the billing cycle in effect at that time.

If there are any changes to the subscription rates, Funnelhyve will notify you in a reasonable amount of time so you can cancel your subscription before the changes take effect.

Prohibited Uses

You agree to pay the revised Subscription fee amount by continuing to use the Service after the change in fees takes effect.

You may only use the Service in compliance with the Terms and for legal purposes. You consent to not using the service:

0.1. in any manner that is contrary to any national, international, or domestic law or rule.

0.2. for the intention of abusing, hurting, or attempting to abuse kids in any manner, whether it is through the exposure of unsuitable content or another method.

0.3. to send, or arrange for the transmission of, any kind of solicitation, whether it be by "junk mail," "chain letters," "spam," or another similar tactic.

0.4. to pretend to be the Company, an employee of the Company, a different user, or any other person or organization.

0.5. In any manner that is harmful, fraudulent, illegal, or in violation of others' rights; additionally, it should not be used in conjunction with any unlawful, illegal, fraudulent, or harmful purpose or conduct.

0.6. to take part in any other activity that limits or impedes someone else's use or enjoyment of the service, or that, in our opinion, could endanger the company, upset service users, or put them in danger of legal repercussions.

And you also consent to refrain from:

0.1. Use the service in any way that could interfere with another party's use of it, including their capacity to carry out real-time activities through it, or disable, overload, damage, or impair it.

0.2. Use any robot, spider, or other automated tool, procedure, or method to gain access to the service for any reason, including keeping track of or duplicating any content found there.

0.3. Without our prior written approval, use any manual process to monitor or copy any content on the Service or for any other unlawful purpose.

0.4. Use any tool, program, or technique that tampers with the Service's ability to function as intended.

0.5. Introduce any dangerous or technologically hazardous content, such as worms, trojan horses, logic bombs, or viruses.

0.6. Attempt to access any portion of the service without authorization, interfere with, harm, or disrupt it in any way, or attempt to access any server, computer, or database that is connected to the service.

0.7. Use a distributed denial-of-service attack or a denial-of-service attack to target the service.

0.8. Do anything that could tarnish or misrepresent the company's rating.

0.9. If not, try to obstruct the Service's smooth operation.

Accounts

By opening an account with us, you attest to the fact that you are older than eighteen and that the data you submit is true, correct, and up to date at all times. If you provide false, erroneous, or out-of-date information, your Service account may be immediately terminated.

It is your responsibility to keep your password and account private, which includes, but is not limited to, limiting access to your computer and/or account. Whether your password is for our service or one of our partners, you acknowledge that you are accountable for all activities or decisions made using your account and/or password. You agree that you are over the age of 18 and that the information you supply us is accurate, complete, and up to date at all times when you create an account with us. You must contact us right away if you become aware of any security breach or unauthorized use of your account. If you provide false, erroneous, or out-of-date information, your Service account may be immediately terminated.

You bear the sole responsibility for protecting the privacy of your password and account, which includes, but is not limited to, limiting access to your computer and/or account. Whether your password is associated with our service or a third-party service, you agree to take responsibility for any and all activities or actions that take place under your account and/or password. If you become aware of any unapproved use of your account or security breach, you have to contact us right away.

The name of another person or organization, a name that is not legally yours to use, or a trademark that is protected by any intellectual property rights of a third party other than yourself may not be used as your username without the proper license. It is forbidden to use any derogatory, profane, or pornographic name as your username.

In our sole discretion, we have the right to reject service, cancel orders, delete or modify content, and terminate accounts.

Intellectual Property Rights

Funnelhyve and its licensors retain exclusive ownership of all rights, title, and interest in and to Funnelhyve (including all intellectual property rights). Without our prior written consent, you are not permitted to use, copy, alter, or distribute any portion of the Services.

Termination

We may terminate or suspend your access to Funnelhyve immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

Disclaimer Of Warranty

YOU EXPRESSLY AGREE THAT YOUR USE OF THESE SERVICES, THEIR CONTENT, AND ANY SERVICES OR ITEMS OBTAINED FROM US IS AT YOUR SOLE RISK. COMPANY PROVIDES THESE SERVICES ON AN "AS IS" AND "AS AVAILABLE" BASIS. COMPANY MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THEIR SERVICES, OR THE INFORMATION, CONTENT, OR MATERIALS INCLUDED THEREIN.

Regarding the completeness, security, reliability, quality, accuracy, and availability of the services, neither the company nor any of its associates make any representations or warranties. In addition, neither the company nor any of its associates guarantees that the services, their content, or any services or products obtained through the services will be accurate, dependable, error-free, or uninterrupted; that defects will be fixed; that the services or the server that makes them available are free of viruses or other harmful components; or that the services, their content, or any services or items obtained through the services will otherwise meet your needs or expectations.

WITHOUT LIMITATION, COMPANY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING FITNESS FOR PARTICULAR PURPOSE, NON-INFRINGEMENT, AND MERCHANTABILITY.

THE ABOVE DOES NOT AFFECT WARRANTIES THAT ARE LIMITED OR EXCLUDED PURPORTED BY APPLICABLE LAW.

 Limitation Of Liability

EXCEPT AS PROHIBITED BY LAW, YOU WILL HOLD US AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS HARMLESS FOR ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGE, HOWEVER IT ARISES (INCLUDING ATTORNEYS’ FEES AND ALL RELATED COSTS AND EXPENSES OF LITIGATION AND ARBITRATION, OR AT TRIAL OR ON APPEAL, IF ANY, WHETHER OR NOT LITIGATION OR ARBITRATION IS INSTITUTED), WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE, OR OTHER TORTIOUS ACTION, OR ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT, INCLUDING WITHOUT LIMITATION ANY CLAIM FOR PERSONAL INJURY OR PROPERTY DAMAGE, ARISING FROM THIS AGREEMENT AND ANY VIOLATION BY YOU OF ANY FEDERAL, STATE, OR LOCAL LAWS, STATUTES, RULES, OR REGULATIONS, EVEN IF COMPANY HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. EXCEPT AS PROHIBITED BY LAW, IF THERE IS LIABILITY FOUND ON THE PART OF COMPANY, IT WILL BE LIMITED TO THE AMOUNT PAID FOR THE PRODUCTS AND/OR SERVICES, AND UNDER NO CIRCUMSTANCES WILL THERE BE CONSEQUENTIAL OR PUNITIVE DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE PRIOR LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

Changes to Terms

Funnelhyve retains the right to amend or change these Terms at any moment, at our sole discretion. If there are any changes, we'll let you know by updating our website with the revised Terms. You agree to the updated Terms if you keep using the Services after any such changes. We will not be liable if for any reason all or any part of Service is unavailable at any time or for any period. From time to time, we may restrict access to some parts of Service, or the entire Service, to users, including registered users.

Governing Law

These Terms will be interpreted and regulated by the laws of the Philippines, which will apply to the agreement regardless of any conflicting legislation.

Any right or condition of these Terms that we do not enforce will not be deemed a waiver of that right by us. The remaining elements of these Terms shall still be in force if a court rules that any one of them is invalid or unenforceable. Any past agreements we may have had regarding Service are superseded and replaced by these Terms, which serve as the whole agreement between us respecting our Service.

Subscriber Responsibility

It is the subscriber's responsibility to learn everything there is to know about Funnelhyve and how to use it efficiently after signing up for our service. Although we offer community support and resources to help in this process, the subscriber bears the final responsibility.

All activities that take place under your account are your responsibility. It is strictly forbidden to use  Funnelhyve for any illegal or forbidden purposes, such as spamming, data scraping, or uploading malicious information.

Indemnification

You agree to indemnify, defend, and hold harmless Funnelhyve and its affiliates from any claims, liabilities, damages, or expenses arising from your use of the service or breach of these Terms.

Amendments To Terms

We may amend Terms at any time by posting the amended terms on this site. It is your responsibility to review these Terms periodically.

Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use Service

Waiver And Severability

No waiver by Company of any term or condition set forth in Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Company to assert a right or provision under Terms shall not constitute a waiver of such right or provision.

If any provision of Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of Terms will continue in full force and effect.

BY USING SERVICE OR OTHER SERVICES PROVIDED BY US, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE AND AGREE TO BE BOUND BY THEM.
